Power of Attorney Requirements

Eligibility to obtain a VA guaranteed loan belongs exclusively to active duty service personnel or Veterans. If the active duty person or Veteran dies, eligibility does not transfer to the Veteran's child or sibling. Many times, the eligibility will not even transfer to the surviving spouse.

If the Veteran or active duty person is not available to sign all of the necessary documents or will not be at the closing, you will need to ensure that he/she knows about the transaction, is alive and well, and, if on active military duty, is not missing in action at the time of closing.

VA will allow a Veteran to use an attorney-in-fact to execute all documents necessary to obtain a VA guaranteed loan. This enables active duty service persons stationed overseas, and Veterans who cannot be present to execute loan documents, to obtain VA loans.
